As a publisher using JuicyAds services, you are responsible for ensuring that appropriate disclosures are made to users in the EEA and UK and that legally valid consent is obtained, where required. Failure to comply with this policy may result in limitations, suspension, or termination of your access to JuicyAds services.
Requirements for Properties Under Your Control
If you use JuicyAds services on any website, app, or other property controlled by you, your affiliates, or your clients, you must adhere to the following obligations for EEA and UK users:
- Obtaining User Consent
- Obtain legally valid consent before:
- Using cookies or other Local Storage technologies for purposes that require consent under applicable law (e.g., non-essential cookies used for personalization or tracking).
- Collecting, sharing, or processing Personal Data for personalization of advertisements or other purposes that require user consent.
- Consent must be informed, freely given, specific, and unambiguous. Do not use pre-ticked boxes, implied consent, or any method that does not constitute an affirmative action by the user.
- Consent Management
- Keep records documenting when and how you obtained user consent.
- Provide users with clear, accessible instructions on how to withdraw their consent at any time. The process of withdrawing consent should be as simple as granting it.
- If the scope of data processing changes materially (e.g., adding new data recipients or purposes), refresh disclosures and seek new consent as needed.
- Data Sharing Transparency
- Clearly identify all Third Parties that may collect, receive, or use users’ Personal Data through your implementation of JuicyAds services.
- Provide accessible information on how each Third Party uses Personal Data. Where possible, link directly to the relevant privacy policies or information pages of these Third Parties.
- If you rely on a Consent Management Platform (CMP), ensure it is compliant with recognized standards (e.g., IAB Europe’s Transparency & Consent Framework) and that it accurately reflects your data practices.
Requirements for Properties Under a Third Party’s Control
If you collect or share Personal Data from users on a third-party property that you do not control, you must use reasonable efforts to ensure the operator of that property complies with these consent and disclosure requirements. This includes verifying that the third-party property has implemented a GDPR- and ePrivacy-compliant consent mechanism and provides necessary disclosures before you engage in data collection or sharing.
